Workshop on Patent Oppositions in the Pharmaceutical Field

Inter-University Centre for IPR Studies (IUCIPRS), CUSAT, and Third World Network are collaboratively organizing the fifth edition of the workshop titled ‘Patent Opposition in the Pharmaceutical Field.’ Scheduled to take place from April 26-30, 2024, the offline event will be hosted at the Inter-University Centre for IPR Studies (IUCIPRS), CUSAT, Kochi.

In the pharmaceutical realm, the granting of patents is closely tied to access to medicines, enabling patent holders to impose exorbitant prices on their products. Multinational companies often pursue multiple patents for life-saving drugs, extending their monopolies and inflating prices, consequently impeding access to essential medications. Patent Oppositions in the pharmaceutical sector serve as a crucial and effective tool to ensure access to life-saving and affordable medicines. This system aids in filtering out frivolous patent applications, contributing to the maintenance of the quality of patents granted by the Patent Office.

Historically, patient groups, Civil Society Organizations (CSOs), and networks have effectively contested frivolous and non-genuine patent applications related to HIV and Cancer. Patent opposition against life-saving drugs has proven instrumental in cost reduction and ensuring accessibility to affordable medicines, particularly in the developing world.

The workshop commences with a concise introduction to the opposition system and its impact on accessing medicines for HIV, TB, Hep C, and COVID-19. It delves into patentability criteria, demonstrating how oppositions play a pivotal role in preventing patents for frivolous and marginal improvements to existing drugs. Following the introduction, the workshop offers a comprehensive review of the patent opposition system in India, encompassing laws related to patentability criteria such as inventive step, novelty, and industrial capability, along with prior art search techniques and strategies for drafting an opposition.

Designed to be interactive, the workshop incorporates group activities, intending to cultivate participants’ skills in reviewing patent applications and prior art. The focus is on enabling participants to judiciously choose the grounds for opposition and draft effective oppositions.  The group activities and individual exercises are meticulously designed to empower participants in seamlessly drafting a patent opposition with minimal difficulty.

The primary objective of this workshop is to foster an understanding of opposition systems and provide practical training that empowers participants to contribute to the reduction of patent monopolies, thereby ensuring broader access to essential medicines.

The workshop is only open to candidates based in India and is open to PG students of chemistry, biochemistry, pharmacy, law, early career researchers in science, faculty members from said disciplines, etc. The workshop is for beginners in the opposition field.  The medium of instruction is English. The workshop is residential. The organisers will bear all expenses of accommodation, travel and food. There is no registration fee for this workshop.
