Doug Bowser, President of Nintendo of America, is suing hacker Gary Bowser for copyright infringement in the ultimate Battle of the Bowsers.
Charges were filed in a western Seattle District Court on Friday, April 16, against Gary Bowser, one alleged leader of Team Xecuter—a known hack creation group. According to Nintendo’s legal team, Bowser and his “pirate operation” have been selling illicit operating systems and tools meant to circumvent the company’s “technological protection measures…put into place to protect its invaluable copyrighted software.”
Bowser is currently being charged with one count of copyright violation and two counts of unlawful trafficking.

Neither Nintendo nor its Switch console has been the only victims of Team Xecuter. The group has been selling piracy software for a variety of consoles as far back as 2004 with the Nintendo DS. They are perhaps best known for their “SX OS” software, as listed in the case documents.
This isn’t a new arena for Nintendo. The company has been known for copyright takedowns of all types from fan-made games to questionable Patreon merchandise. In fact, this isn’t even their first interaction with Bowser. He and his associate, Max Louarn, were originally arrested and charged with 11 felony counts related to hack reselling—also known as “jailbreaking”—in May 2020.
Team Xeucter has since disputed those claims and instead accused the major publisher of legal intimidation and unlawful censorship, among other things.
Nintendo is seeking $150,000 USD for the copyright, $2500 USD for each console, and the immediate termination of Team Xeucter.
The case is currently still pending litigation.
