1st Circ. OKs CarData’s Jurisdiction Win In Trademark Fight

By Tiffany Hu (January 19, 2022, 9:02 PM EST) — The First Circuit has upheld a lower court’s dismissal of a trademark lawsuit against a Canadian employee reimbursement company, finding that the company wasn’t subject to personal jurisdiction in Massachusetts, where the case was filed.

In a published opinion issued Tuesday, a three-judge panel said a Massachusetts federal judge correctly rejected Motus LLC’s arguments for sustaining its lawsuit against Toronto-based CarData Consultants Inc., which Motus accused of infringing its “strong rights” in the phrase “corporate reimbursement services” on CarData’s website.
